The rules for using FirstGrade — your account, plans and billing, acceptable use, what our AI features do and do not promise, and how disputes are handled.

1.This agreement
These Terms of Service are a binding agreement between you and FirstGrade Edu Solutions Pvt. Ltd.(“FirstGrade”, “we”, “us”), the company that operates firstgrade.in and its apps. Registered office: TO BE CONFIRMED — Registered office address. CIN: TO BE CONFIRMED — CIN (Corporate Identity Number).
By creating an account or using FirstGrade, you accept these Terms and our Privacy Policy. If you do not accept them, please do not use the service.
FirstGrade is built for students, including school students. Our minimum age and guardian-consent rule is: TO BE CONFIRMED — Minimum age / guardian consent rule.
If you are using FirstGrade on behalf of a school, college or company, you confirm that you are authorised to accept these Terms for that organisation.
You may not use FirstGrade if we have previously terminated your account for a breach of these Terms.
3.Your account
Give accurate details when you register, and keep them up to date.
Your account is personal to you. Do not share your login, and do not let anyone else attempt tests, interviews or discussions as you.
You are responsible for everything that happens under your account. Tell us at once at firstgrade@firstgrade.in if you suspect unauthorised access.
You may delete your account at any time. Deleting it ends your access; see the Refund Policy for what happens to a paid plan.
4.Plans, billing and cancellation
Free and paid plans
FirstGrade has a free tier and paid plans. The features and prices of each plan are shown on our pricing page, which forms part of these Terms. We may change plans, features and prices; if we increase the price of a plan you already hold, the change applies from your next renewal and we will tell you first.

Payment
Payments are processed by Razorpay, which accepts UPI, debit and credit cards, net banking and wallets. Your card and bank details are handled by Razorpay under their terms — we never receive or store them.
Free trial and cancellation
Where a plan is offered with a free trial, you are not charged until the trial ends and you may cancel during the trial. You can cancel a subscription at any time from your account; your access continues until the end of the billing period you have already paid for, and it does not renew after that.
Where a school, college or organisation buys seats, the signed agreement or purchase order with that organisation governs the commercial terms, and these Terms govern each individual user’s use of the service.
5.Acceptable use
When using FirstGrade, you agree not to:
Copy, scrape, bulk-download, republish or resell our questions, solutions, explanations, study material or any other content — whether manually or with automated tools.
Share paid content with people who have not paid for it, or share your account credentials.
Attempt to break, probe or bypass our security, rate limits, access controls or payment checks, or use the service through unauthorised automated means.
Reverse-engineer the platform, or use it to build or train a competing product or model.
Upload or submit anything unlawful, abusive, hateful, sexually explicit, defamatory, or infringing someone else’s rights, or anything containing malware.
Impersonate anyone, or misrepresent your identity, school, marks or achievements.
Harass or abuse other users, our staff, or the AI participants in group discussions and interviews.
Interfere with another user’s use of the service, or place an unreasonable load on our infrastructure.
Cheating in a proctored test, using another person to attempt an assessment for you, or manipulating scores or leaderboards may result in the affected results being voided and your account being suspended or terminated.
6.Assessments and proctoring
Some tests are proctored. When a proctored test is running, your browser analyses your camera feed on your own device to check that you are present and looking at the screen, and records only the resulting warnings against your attempt. The video is never uploaded — this is explained in full in the Privacy Policy.
Repeated warnings may end an attempt automatically. We may void an attempt or a result where we reasonably believe the assessment was not completed honestly.
Scores, ranks, predicted scores and analytics are indicative practice tools. They are not affiliated with, endorsed by, or predictive of any official examination body’s result.
7.Content and intellectual property
Our content
The platform, its software, design, question banks, solutions, explanations, study material, diagrams and branding are owned by FirstGrade Edu Solutions Pvt. Ltd. or licensed to us, and are protected by copyright and other laws. Your subscription gives you a personal, non-transferable, non-exclusive right to use them for your own preparation. It does not transfer ownership of anything.
Your content
You keep ownership of what you create and upload — your answers, essays, code, resumes and messages. You grant us the limited licence needed to run the service: to store, process, transmit and display that content to you, to send it to the AI and infrastructure providers listed in our Privacy Policy so the feature you asked for can work, and to generate your evaluations and analytics.
Where you take part in a group discussion with other participants, they will hear and see your contributions during that session.
Third-party names
Names of examinations, boards, universities, colleges and companies are used only to describe the preparation material they relate to. FirstGrade is not affiliated with, authorised by or endorsed by any of them unless we state so explicitly.
Reporting infringement
If you believe content on FirstGrade infringes your rights, email noreply.firstgrade@gmail.com with enough detail to identify the content and your claim, and we will investigate.
8.AI features — what we do and do not promise
FirstGrade uses AI for its doubt solver, evaluations, resume tools, mock interviews, group discussions, study plans, score predictions and career guidance.
AI output can be wrong. Answers, scores, feedback, predictions and career or admission advice generated by AI are for practice and guidance only. They are not professional, legal, medical, financial or admissions advice, and they are not a guarantee of any result. Always verify exam dates, eligibility criteria, cut-offs, fees and application deadlines against the official source before you act.
Evaluations of essays, interviews and discussions are automated approximations of how a human evaluator might score you. They carry no official standing.
9.Promotional guarantees
Where we advertise a specific guarantee on our pricing page, the terms of that guarantee are: TO BE CONFIRMED — "Selection Guarantee" — exact terms.
Except for a guarantee published in these Terms, we do not promise any particular exam result, score, rank, admission, internship or job outcome from using FirstGrade.
10.Availability and changes to the service
We work to keep FirstGrade available, but we do not guarantee uninterrupted service. Features may be added, changed, restricted or withdrawn, and the platform may be unavailable during maintenance or because of failures at our infrastructure providers.
We may also place the platform, or parts of it, into a temporary restricted or invitation-only mode — for example to protect content, to manage capacity, or to respond to abuse. If that happens while you hold a paid plan and it prevents you from using what you paid for, contact firstgrade@firstgrade.in and we will make it right under the Refund Policy.
11.Suspension and termination
We may suspend or terminate your access if you breach these Terms, if your use puts the platform, its content or other users at risk, or if we are required to by law. Where it is reasonable to do so, we will warn you first and give you a chance to put things right.
You may stop using FirstGrade and delete your account at any time.
Sections that by their nature should survive termination — intellectual property, disclaimers, limitation of liability, indemnity and governing law — continue to apply afterwards.
12.Disclaimers and limitation of liability
Except as expressly stated in these Terms, and to the extent permitted by law, FirstGrade is provided “as is”. We do not warrant that it will be error-free, uninterrupted, or that its content, scores or predictions will be accurate or complete.
We are not liable for indirect or consequential loss, or for loss of opportunity, admission, rank, employment or anticipated savings.
Our total liability to you in connection with FirstGrade is limited to: TO BE CONFIRMED — Limitation of liability cap.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Indian law, including liability for fraud, and nothing here affects the rights available to you as a consumer under the Consumer Protection Act, 2019.
13.Indemnity
You agree to indemnify FirstGrade Edu Solutions Pvt. Ltd. against claims, losses and reasonable costs arising from your breach of these Terms, your misuse of the service, or content you upload that infringes someone else’s rights or breaks the law.
14.Complaints and grievance redressal

15.Governing law and jurisdiction
These Terms are governed by the laws of India.
Exclusive jurisdiction over any dispute lies with: TO BE CONFIRMED — Governing-law jurisdiction.
16.Changes to these Terms
We may update these Terms as the product and the law change. The “last updated” date at the top of this page always reflects the current version, and we will give notice of material changes by email or an in-product notice before they take effect.
Continuing to use FirstGrade after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the service and, if you hold a paid plan, contact us.
